The digital platform, identified as BINARYPULSE SOFTWARE PRIVATE LIMITED ("Website" or "Site"), alongside its associated mobile applications ("Applications"), is owned and operated by BINARYPULSE SOFTWARE PRIVATE LIMITED, hereinafter referred to as "The Crickethub," "the Organization," "we," "us," and "our." These terms and conditions govern your access and utilization of the Site and Applications. Your continued use of the Site and Applications implies your consent to adhere to these terms. Should you disagree with any of these terms, please discontinue using the Site and Applications immediately.

USE OF The Crickethub

By utilizing the services offered by The Crickethub, users acknowledge and agree to any modifications made to the existing Terms and Conditions, rules, regulations, and usage policies by The Crickethub. If a user disagrees with these modifications, The Crickethub reserves the right, at its sole discretion, to limit the user's access to the services and features provided.

The Crickethub is authorized to establish general guidelines and restrictions for The Crickethub.com, which may include the deactivation or deletion of user accounts, the removal of submitted content, and the implementation of general practices and restrictions.

In cases of user violation or improper use of The Crickethub.com or its features, The Crickethub reserves the right to limit, suspend, or terminate user access, deactivate or delete user accounts and information, and take legal or technical action as deemed necessary.

ACCOUNT REGISTRATION

To access restricted areas and services on the Site and Applications, users may need to register for an account. By applying for an account, users acknowledge and confirm the accuracy of all provided information. The Organization reserves the right to reject enrollment for any account under any circumstances.

Registered users must treat their account sign-in information as confidential and refrain from disclosing it to any third parties. Users agree to promptly notify The Crickethub of any unauthorized use of their sign-in information or any other security breach. The Organization is not responsible for any loss or damage resulting from the user's failure to comply with this agreement.

ELIGIBILITY REQUIREMENTS

To establish an account, participate in skill games, or have the chance to win prizes, individuals must be at least 18 years old. Residents of certain Indian states are restricted from contest participation. Additionally, only Indian citizens are permitted to create accounts on The Crickethub.

PAYMENTS

Users have various payment options available, including Internet Banking/Debit/Credit Cards (referred to as the "Virtual Payment Mode"). Users acknowledge that the processes and information related to Virtual Payment Modes are governed by agreements between users and relevant institutions. In the event of any liability associated with Virtual Payment Modes, including fraudulent transactions, we bear no responsibility.

We are not liable for any direct or indirect loss or damage resulting from (a) transaction disapproval, (b) payment issues arising from the transaction, or (c) transaction decline for any reason. Users understand that the payment service we provide is not a banking or financial service. The Crickethub reserves the right to modify fees associated with the Services without prior notice, and such changes are binding on users.

WITHDRAWALS

Users submitting withdrawal requests are advised to monitor their registered email for correspondence from The Crickethub if the request is processed a few days after submission. Violations of Fair Play Terms may result in user restrictions and the suspension of withdrawal requests. Users found in violation may be blacklisted, leading to the denial of withdrawal requests. Under normal circumstances, withdrawals typically take 5 to 7 business days.

CONDITIONS FOR WINNING, WINNER SELECTION, AND VERIFICATION

Winners will be selected based on predefined criteria set by The Crickethub. In cases where there are multiple pre-designated winners, selection will be based on the order of their combined scores after the relevant round of the Contest.

Before the game commences, The Crickethub will specify the number of winners and the corresponding winning amounts. In the event of a tie, winning participants will be declared joint winners, and winnings will be equally distributed among them.

Users must adhere to The Crickethub' terms and conditions to ensure The Crickethub is not released from any obligation to pay winnings related to the use of its platform. If a player in the paid versions of the Contest(s) is identified as a resident of the aforementioned Indian states, The Crickethub reserves the right to disqualify that player and forfeit any accrued winnings.

In cases where both users in a head-to-head competition have identical teams with the same players, captain, and vice-captain, no winner will be declared. The entry fees for both users will be reimbursed to their The Crickethub user accounts.

GENERAL REQUIREMENTS

The company reserves the right to cancel or withdraw any ongoing Contest(s) at any time if deemed necessary to comply with governmental, statutory, or regulatory requirements, approvals, or if the Contest(s) are found to be unlawful or prohibited by law. Users of The Crickethub services agree to refrain from taking legal action arising from such cancellations or withdrawals. No person who is an employee, director, affiliate, relative, or family member of The Crickethub is eligible to enter any Contest.

INTELLECTUAL PROPERTY

The company (or its licensors) maintains complete ownership and exclusive rights to the Site and Apps, including graphics and content. Users do not acquire any ownership titles or interests in these rights.

DISCLAIMER AND LIMITATION OF LIABILITY

Users acknowledge that accessing and utilizing the features offered by The Crickethub is done willingly and at their own risk. By doing so, users agree not to hold The Crickethub accountable or responsible for any loss or damage incurred, including but not limited to accidents, injuries, deaths, or property loss during access to the features, including participation in the Contests or as a result of accepting any winnings.

TERMINATION AND SUSPENSION

The Company retains the authority to suspend or terminate your access to the Site and Applications, without notice and without refund, at its sole discretion, for violations of these terms or any misuse of the Site or Applications. In case of multiple violations, the Company may take action against all associated accounts. The Company also reserves the right to remove the Site and Applications at any time without assuming liability for any resulting loss or damage.

SEVERABILITY

If any provision of these terms is deemed invalid, unlawful, or unenforceable by a court or competent authority, that specific provision will be modified or removed, while the remaining terms will remain valid to the extent permitted by law.

WAIVER

The Organization's failure to enforce any obligation under these terms or exercise its rights or remedies does not constitute a waiver. The Organization's waiver of one default does not waive subsequent defaults. No waiver by the Organization of your obligations under these agreements is valid unless expressly stated in writing.

RESTRICTED SERVICES

Services are not available in Odisha, Andhra Pradesh, Arunachal Pradesh, Telangana, Assam, Sikkim, and Nagaland due to legal restrictions.

GOVERNING LAW AND JURISDICTION

The user and The Crickethub mutually agree that the courts of India will have exclusive jurisdiction to resolve disputes arising from or related to these agreements.
